We are currently living in Arizona and are considering moving to Florida. We have a daughter with autism who is high functioning and can care for herself and live alone, with us providing regular visits. She is not capable of understanding money or any complex issues. Because of her supplemental security income rules we are not guardians just conservators. Because of this we would title a condo for her in the name of a trust. Under these circumstances, can she receive a homestead exemption?

Russ,

The answer is absolutely yes. Trusts can also claim the tax exemption along with the equity protection. There is plenty of information on this BBS regarding this subject-matter particularly HERE. You will more than likely have to file a supporting document upon closing or deed transfer with the county recorder so that the information is available to the county property appraiser, otherwise they may deny the tax exemption for the trust and you'd have to then fight the issue unnecessarily. We can help with that issue.

Let us know if we can be of further assistance.
