Exemption of homestead from forced sale and from having a judgment or execution being a lien thereon differs from homestead exemption, as defined for tax purposes.

John,
I am being personally sued from an auto accident in 2005. My home is Homesteaded but is it possible for a lien to ever be put on it when it is sold?

Lin,

Although a lien will apply against any and all real or personal property, a lien is not allowed to be foreclosed against homestead property. The mortgage company will most likely force you to pay it in order to obtain title insurance, but the law allows a way around that.
