I have a serious problem I need help with. I own a condo in Clearwater, Fl. which has been homesteaded. Two and a half years ago, I moved to Panama City Beach because of the job opportunity (I'm a Realtor) and this has been my primary residence but I did not change my homestead.

Now ... because of the drastic effects of the real estate downturn .. I am not making the income I was and I cannot afford to make my mortgage payment. I've been told that I cannot negotiate with the Lender (Countrywide) because this is not my homesteaded, primary residence and, if my situation results in a "short sale", I will be issued a 1099 and be responsible for the taxes on the short sale deficiency.

My question is: Can I switch the homestead from the Clearwater condo to my home in PCB so I can negotiate with the Lender or is it too late to take this kind of action?

Rick,

Yes you can apply at any time for the county property tax exemption. Also our Declaration of Homestead process will solidify any doubt by the mortage holder and prove your residency and primary residence is PCB, regardless of any tax exemption.
