I live in Dade County Florida. Less than one year ago my wife filed for divorce and left the family. The divorce litigation has been drown out for a year now; before the filing for divorce, my wife accumulated over $60,000 worth of credit card debt without my knowledge; the credit cards were taken out in her name, and the collection agents are chasing her for repayment; but they have since called me because she does not respond to them, and they are threatening to put a lien on our home.
Final arguments have been filed with the court, and the judge has not ruled yet whether the debts will be considered marital or non-marital assets; my wife has given me the house as part of the recommended settlement, but until the divorce is finalized, the home is in both of our names on the title and on the mortgage.
Can the creditors or collection agencies who buy their debt file judgements against me, and put a lien on my home or not? If so, What can I do to protect my home from creditors liens?
