My husband and I bought a home in Florida and lived there for three years while on military ordes. He is still a memeber of the military, but we have since got orders to transfer to another state. We still own the home in Florida, but now have it rented out until we make it back to the state to live ourselves. My husband claims Florida and the house as his state/address of legal residency. Now with the new MSRRA law that went into effect, I am going to reclaim Florida as my state of legal residence as well. (I had to change to the current state we are in prior to this new law being passed). Do we still claim the Homestead Exemption since we have our home rented for the time-being, even though we claim Florida and our home's address as our place of legal residency?
