1st time application homestead denial rental constitutes abandonment

I applied for the homestead exemption for the first time in 2015 and was denied based on F.S. 196.061. It seems clear that this exception only applies to someone who already had a Florida homestead and that is what I plan to argue at the upcoming appeal. The language in the law seems so obvious that I'm worried I might be missing something. Is there any case law regarding this?

Yes, you may be correct. In addition, there is plenty of case law on the rental issue. Please do a search (Use the link in the upper task bar). What is the specific reason(s) for denial regarding a rental? If you need more information, please feel free to email us at myhomestead@bellsouth.net
