I lent a friend money, I know mistake, but it is a large sum of money $170,000. when he was in trouble of losing his place. He sold place and then instead of paying me we agreed to build another house together. He owned land (cause the money I lent him paid off the debt on the land) and that was his investment. The 170 was to be my investment. Or loan for the the property. He signed a promisary note. He late stole the note from my home and then said that he was not going to pay. He sold house and put the money in another homestead while I was sueing him in court. I got judgement but now all the funds are in another homestead. Lawyers are saying that I am out of luck.. PLease tell me this is not true. Can you kill someone in Floride steal their money and put it in a homestead and it is protected?? Help me please!!! I have been swindled of my lifes savings. This can not be legal

I have a similar problem. How can FL allow people to get away with not paying their debt ? How can they be allowed to keep their homes while robbing the people they borrowed money from of their own homes and lives?

Fortunately or unfortunately, depending on how you see it, the voters of the State of Florida voted in the Constitutional Amendment. The legislature has no choice but to uphold the wishes of the electorate.

So the corrupt win?
I made a loan in good faith and even though the debtor does not dispute this he has no reason to pay me back. A judgment against him is no incentive at all as all his assets (including lavish home, pension etc) are exempt. Is there any case record at all that allowed for lien on personal property in case of fraudulent personal debt?

That is great. My debtor is keeping good company,

What does the FL law do to protect a creditor - an innocent person who made a loan and who has not done anything illegal? how can you get your money back?

Sue them and hope that they have non-exempt assets to go after...
