Buying and finding out there is a county lein on it.

Hi, we are buying a home and have been informed that there has been a 100.00 a day fine accruing on it since June or so of 2003, we are also being told there is a lien on the property for that amount and they may foreclose on the property due to the lien, what can and should we do, we don't want to be homeless. Thank you

What type of lien is it? If it is a code enforcement lien, they cannot foreclose on homestead property.

it is a code enforcement lien and we were told it is almost 200,000.00 now due to 100.00 a day since june of 2003 or there abouts,we were also told that they could and may take the property, and when going on the property appraisers site the house is no longer showing up under the owners name. I had looked about 5 months ago and it was under their name then, so not sure what is going on.

Absolutely not true. The law specifically states that no code enforcement lien can be forclosed on homestead property.

Although the statute merely provides that any lien created pursuant to an administrative fine may not be foreclosed on real property which is homestead, the Constitution itself goes much farther: No such lien exists as to such homestead property. Since that is true, the mere recording of the order cannot constitute a cloud against a homestead property. 618 So. 2d 754, 18 Fla. Law W. D, 1122 DEMURA v. COUNTY OF VOLUSIA (Dist. Ct. App. 5th Dist. 1993)

A few days ago, the tiny little town of Lake Hamilton with maybe 1500 residents (including pets) and a budget of 2.5 million decided to play hardball and supposedly put a $2100 lien against my homesteaded property. They have gotten too ig for their britches and believe they have found a new way to pay the bloated salaries of way more staff than will be needed in the next 50 years. Please fell free to comment and help me figure out what to do to put them back in their place. I have lived in this town for the last 35 years and have only had problems in the last couple of years. Don't plan to move, but need to figure out what I can do. Thanks.
