Know your Options

If you are facing foreclosure you have the following options available :

1. File Bankruptcy A Chapter 13 bankruptcy will stop the foreclosure on your home. But there are very real and unpleasant consequences. An attorney will charge between $1,000.00 and $2,500.00 to file it, and for the next 3 to 5 years you will have to place your entire financial life under the auspices of the Trustee. You cannot make any new debt without the Trustee's approval. And when it's over, you still have a bankruptcy on your credit.

2. Call the attorney for your lender and try to work it out. Your lender hired their attorney for one reason only...... to take possession of your property through foreclosure!! That's how he gets paid. It's not in his interest to work out anything with you. If you've called their attorney, you were probably told, " send in the entire mount or don't send anything." In most cases, this amount will include all arrearages plus late fees, interest and attorney fees. Usually several thousand dollars.

3. Call the lender to obtain a workout. Most lenders have a loss mitigaition department. Most loss mitigation specialists in most mortgage companies are very overworked> To work out a solution for you means more work for them. Plus when you submit your financials to them, there are expenses that most times, they won't even ask you about. We know how to adequately represent your income and expenses to insure that you qualify. If you are not aware of mowst lender's formula for qualifying a homeowner of loss mitigation, you could give damaging or less than favorable information to your lender. We never lie to your lender, we make sure that your financial situation is accurately presented, taking into account all sources of income and all expenses that you incur. We also make sure that your lender does not place you in a position where your payments in any forearance plan is not too high, leaving you without enough money to meet your other obligations as well as meet any emergency or unforseen obligations.

We are familiar with all loss mitigation solutions available, some of which include:

a. Re-amortization - Also known as re-writing the loan, which brings your account current with a fresh start.

b. Deferment - Used in many cases, a deferment simply puts the past due amount onto the end of the payment schedule.

c. Repayment Agreement - Past due amount is spread out over a period of time until it is paid.

d. Partial Claim - A portion of, or all of the past due amount is forgiven, and the homeowner starts fresh.

e. Refinancing - We work with several different lenders, including some private lenders, that will refinance a property in foreclosure. Each situation is evaluated on it's own merits.

f. Buyback program - We have organizations that will purchase your home and re-sell it back to you. You will lose a little equity, but you will not lose your home and you will not have to qualify for the new mortgage.

g. Humanitarian Grant Programs - We have an organization that will pay your home off and deed it to you. You have to qualify for this assistance, but most people do. Call us to see if this option is for you. There is no gimmick to this option, and you pay for their service after your homes is paid off and deeded back to you.
