Notice of Intent to Enforce, Protect and Defend Real Property Rights

KNOW ALL MEN BY THESE PRESENTS that the below named natural person intends to enforce and defend private property rights and posted property, to wit:

1. Affiant(s): NAME; Birth Date: ____________; Country - State: United States, State of Florida

2. Brief description of real property claims:

3. Parcel Information: Parcel ID ________________; LEGAL DESC:___________ ADDRESS: ______________________

4. Alternative Description(s): Public Notice, Warning, Notice of No Trespassing, Notice of Foreign Law on Private Land, Land Use Fee

5. Type of Notice: Public Notice to all public, private, federal and local government, and all other entities, Officers of the Law, Government Officials, Agents or Agencies acting under color of law

6. Public Notice(s): NAME, and all who reside at the below real property hereby give Public Notice of Intent to Enforce, Protect and Defend Real Property Rights and Private Property rights and Posted Property. Affiant(s) and Owner(s) intend to protect and defend the aforesaid real property enumerated herein from any and all claims and trespassers. All person(s) and entities enumerated in item 5 are hereby put on notice that the aforesaid property is private property and is hereby publicly posted against trespass. As such, all rights by the Constitution and General Laws of Florida are hereby claimed. No claims or demands of any kind by any entities or person(s) enumerated in item 5 will be recognized without full due process of law. This Public Notice and Notice of No Trespassing will be used as prima fascia evidence of public notice and prior legally sufficient warning.

7. Additional notice and information: Affiant invokes the 'Castle Doctrine-SB 436; Ch. 2005-27; AGO 2002-27' and a 'Land Use Fee' of Five-Thousand dollars per day, charged to any natural person(s) or entities enumerated in item 5 ("Lessee(s)") for entering upon the aforesaid land without prior written permission by the owner(s) which will become a lien against the same. If any entity enumerated in item 5 enters upon the aforesaid property or land to execute a warrant or legal service of any kind, it must comply completely with the fourth, fifth and fourteenth articles of amendment, Constitution for the United States and be valid on its face according to statute and be in physical possession for inspection and determination as required by due process of law prior to any action or execution. Said entity must personally sign all documents, demands or requests which may be left on the property or its easement(s) for inspection. By trespassing or entering upon the aforesaid land without valid warrant issued by a court of competent jurisdiction, you will have violated your oath of office and applicable law(s) promulgated thereunder.

8. Rights Claimed: ALL RIGHTS RESERVED; ANY AND ALL RIGHTS to publicly display, and perform any work, improvements or any derivative thereon based on the laws enumerated in the Florida Constitution and General Laws of Florida. All State and Local Codes, Ordinances and Statutes are hereby rebutted as valid law due to no enacting clause and non-implementation by the State of Florida Legislature.

9. Affiant intends to fully enforce applicable valid law(s) for any and all unauthorized use or trespass of land, real property, easements and facsimiles thereof stated herein. Ignorance of the applicable law(s) will not be an excuse, nor shall it relieve any natural person(s) or entities under item 5 from liability therefor. Violations of the rights claimed herein shall be assessed a civil penalty of one million dollars for each violation. Damages will be prosecuted under Title 18 USC 1621; 241, Title 42 USC 1983; 1985; 1986 resulting in up to ten years in prison and additional penalties. Violators will be prosecuted to the fullest extent of the law. Govern yourself accordingly.
