I'm planning on living overseas and I want to rent our primary residence for 1 year starting January 5th and returning on January 2nd of the following year. I understand there is a statute that contains an exception, which states that a property owner who rents out his homestead for more than 30 days per year for two consecutive years will lose the Homestead exemption tax benefits for that property. I would like to know if I will be able to keep my benefits, meaning Homestead and the ad valorem tax benefit on our property.

RJQ - If you live on or in the property as a primary residence as o January 1st, then the exemption remains intact for the entire year, however the following year (which the 2 year rule is applicable) may be an issue if the property is rented over 30 days.
