I have been separated from my husband for 2 years. Original home was purchased in both names in KY. I have just purchased a home in Florida in my name with my money. We do not see each other at all. In KY you cannot get an exemption until you are 65 years of age. We both are 61 years of age. I just need to know if I can claim exemption in FL even after he turns 65? I read where that is legal as long as you don't support each other? What if each spouse receives their own retirement pension plus a small portion of the other spouse's retirement pension? Does this count as supporting each other even though we both have our own income?

You can claim the exemption in FL as long as the property is a primary residence. You should also be able to claim it since your income soley supports you, and the husband's income is not used to support you.
