I am closing on my Florida home 12/29/2009. I intend to move in as a full time resident sometime in January. I confused about meeting the criteria of being a full time resident on January 1st,
When I close will I be able to claim a homestead exemption? I am closing by mail due to travel constraints of the holiday week. I won't be able to get a Florida drivers license or register to vote until early January.
I will have the deed in the name of my revocable trust which was drawn up in Massachusetts. Does this matter?
Finally, in reading up on the Florida intangible personal tax, it appears to presently apply to a very limited type of securities and most stocks and bonds are exempt. Do I have this right?

Phil,

Since you will have legal title as of January 1st, you will be eligible for the exemption as long as the property is your primary residence. A trust can claim homestead, but there is specific wording that should be included in the deed. I don't know in regards to your intangible tax issue. I would contact the Florida Department of Revenue for details on the law. Contact me at myhomestead at bellsouth dot net for details.

I closed on my new home on 12/29/2009 and had the electricity put in my name on that date but the gas wasn't turned on until after the first of the year. The application says I'm authorizing "the agency to obtain information from utility companies or all other sources to determine my eligibility for the exemption applied for"

Because of the holiday and the fact that I couldn't find my SS card, I wasn't able to get registered to vote and secure a Florida drivers license until after the first of the year. Will this mean I lack the evidence I need to prove residency?

The application also asks "Move in date". Does it matter if I stayed with a friend while I waited on furnishings?

Not an issue. Voter registration is not required to obtain homestead, just because the gas was not on is not a reasoin to deny homestead. Move in date should be 12/30/09.

Thanks very much for your help. My application was approved last week.

There was a small "bump in the road" as I needed to supply documentation from my former Massachusetts home town stating my residential exemption there was rescinded. Furthermore, this only became an issue because the Manatee county application asks if you currently have an exemption and if so where.

It's great to be a Floridan!
