Fraud and Fraudulent Transfer

Fraud regarding a homestead is where the debtor acquired the homestead using non-exempt funds with the specific intent of hindering, delaying, or defrauding creditors in violation of Fla. law. The imposition of an equitable lien against a homestead is not justified under Florida law if the debtor did not fraudulently obtain the funds which were transferred to the homestead property. :-p
