Under the new bankruptcy law in Florida, in bankruptcy cases homestead protection is available up to $137,000, or up to $274,000 for a jointly owned homestead. An exception would apply if the debtor occupied a current homestead property and previous homestead properties in Florida for 40 continuous months. But this new bankruptcy law does not affect homestead protection outside of bankruptcy.
