Wrongful Garnishment

What should I do if a garnishment was applied to my checking & savings account, but I was in no way involved with the case proceedings.

My father is currently in a dispute with the state of CA for some back taxes, but my entire checking and savings have been wiped out because of a court order evolving this case. I haven't lived with my parents for ten years. I was under the age of 18 when I opened my account so my mother's name is also on it. The state of CA saw this as ample reason to take every penny I have.

Do I have a case for wrongful garnishment, & can I seek financial compensation for the many troubles this has caused me?

How can a granishment be applied to your account if you are not responsible? Were you not a party to the proceedings? If not, you may definitely have a wrongful garnishment case. What are the CA laws on the subject? If you are a Florida resident, they may have broken FL law.

I was in no way a party to the proceedings.

The only connection I have to this garnishment is that it has been filed against my father & my mother's name is also on my account.

I have never been to the property the taxes are due to & I have not lived with my parents for ten years. I was never informed of a looming garnish & the removal of my checking & savings was a complete surprise. My name is in no way associated with the property being taxed.

I don't even live in CA. The last time I lived in CA was when I was 2 years old.

You have got to somehow reverse the garnishment through the CA court system. We will be happy to help in regards to the Fla laws. Contact us at myhomestead@bellsouth.net
